Any lawyer that argues that Senator Ademola Adeleke is entitled to be issued certificate of return and sworn in immediate has poor knowledge of law
It was like a drama today during a live programme of channel television known as Sunrise Daily when Barr Kolapo Alimi and Barr Niyi Owolade expressed divergent opinions on whether the INEC should issue certificate of return to Sen Ademola Adeleke so that he can be sworn in immediately. Barr Niyi Owolade expressing his opinion on this issue as a lawyer said INEC is under obligation to obey the order of the Tribunal immediately by issuing a certificate of return to Sen Ademola Adeleke and he should be sworn in immediately. However, in his response, Barr Kolapo Alimi states that any lawyer that argues that Senator Ademola Adeleke is entitled to be issued certificate of return has poor knowledge of law in view of the clear provision of S. 143(1) of the Electoral Act which allows the incumbent to remain in office if he gives notice to Appeal within 21 days of delivering of the judgement and which allows the incumbent to remain in office until the appeal is determined. He then concluded that the position expressed by Niyi Owolade is not correct position of law.
